RETURN POLICY

 

If you purchase a product from Woman Powerhouse through our online store, you have the statutory right of withdrawal described below. This policy explains how to exercise that right, how returns are handled, and what rights you have if a product is defective or does not conform to the agreement.

This Return Policy applies to consumer purchases made through the Woman Powerhouse webshop and is based on applicable Dutch and European consumer protection legislation. Nothing in this policy limits mandatory consumer rights.

1. RIGHT OF WITHDRAWAL

As a consumer purchasing a physical product online, you generally have a statutory right of withdrawal. You may cancel your purchase without giving a reason within 14 days after the day on which you, or a third party designated by you other than the carrier, receive the product.

If your order contains several products delivered separately, the withdrawal period starts on the day after you receive the last product. If a product consists of several lots or parts delivered separately, the period starts on the day after you receive the last lot or part.

You do not have to provide a reason for exercising your right of withdrawal.

2. HOW TO EXERCISE YOUR RIGHT OF WITHDRAWAL

To exercise your right of withdrawal, you must notify Woman Powerhouse within the 14-day withdrawal period by sending a clear statement that you wish to cancel your purchase. You may use the model withdrawal form at the end of this policy, but this is not mandatory.

After notifying us, you must return the product without undue delay and no later than 14 days after the day on which you notified us of your withdrawal. You meet this deadline if you send the product before the 14-day period has expired.

Please include the following information where possible:

·  Order number.

·  Full name and contact details.

·  Product(s) being returned.

·  Copy of the order confirmation or proof of purchase, if available.

4. CONDITION OF RETURNED PRODUCTS

During the withdrawal period, you may unpack and handle a product only to the extent necessary to assess its nature, characteristics and functioning, in the same way you would reasonably be permitted to do in a physical shop.

You are responsible for any diminished value resulting from handling the product beyond what is necessary to inspect it. Where permitted by law, Woman Powerhouse may deduct the amount of such diminished value from the refund.

We recommend returning products with all included accessories and, where reasonably possible, in their original packaging and with suitable protective packaging.

Please package the product securely so that it is protected against damage during return transport.

5. RETURN SHIPPING COSTS

Unless Woman Powerhouse has expressly agreed to bear the return costs, you are responsible for the direct cost of returning a product when exercising your statutory right of withdrawal. The applicable information about return costs will be provided before or at the time of purchase.

If you return a product because it is defective, damaged, incorrect, or otherwise does not conform to the agreement, Woman Powerhouse will bear the applicable return costs where required by law.

6. REFUNDS

If you validly exercise your right of withdrawal, Woman Powerhouse will refund all payments received from you for the returned order, including the cost of the least expensive standard delivery option offered by us.

If you chose a more expensive delivery method than the least expensive standard delivery option offered by us, Woman Powerhouse is not required to refund any additional costs resulting from your choice of the more expensive delivery method.

Woman Powerhouse will process your refund once we have either received the returned product or received valid evidence that the product has been sent back, whichever occurs first. The refund will be made no later than 14 days after the day on which you notify us of your decision to withdraw, unless Woman Powerhouse has not yet received the returned product or valid evidence of its shipment by the expiry of that period. In such circumstances, Woman Powerhouse may withhold the refund until the returned product or valid evidence of shipment is received.

Once we have received the returned product, or you have provided valid evidence that you have sent the product back, whichever occurs first, Woman Powerhouse will process your refund without undue delay and normally within 5 working days. Where the returned product is received after the applicable 14-day period has expired, Woman Powerhouse will process the refund without undue delay and, in normal circumstances, within a few working days of receiving the returned product. The applicable statutory requirements will apply in all circumstances.

The refund will be made in accordance with the applicable statutory requirements. We may deduct any amount reflecting diminished value of the product resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product, where permitted by applicable law.

Refunds will normally be made using the same payment method used for the original transaction, unless you have expressly agreed to another method. No fee will be charged for receiving the refund.

If you return only part of an order, the original delivery costs are not refunded.

The direct costs of returning the product are your responsibility, unless Woman Powerhouse has expressly agreed to bear these costs or applicable law requires otherwise.

The customer is responsible for packaging the product appropriately when returning it. The product should be securely packaged to prevent unnecessary movement or damage during transportation and should be returned in a condition that allows Woman Powerhouse to inspect it. All returned products may be inspected upon receipt.

If a returned product is damaged as a result of inadequate packaging or handling by the customer that goes beyond what is necessary to establish the nature, characteristics and functioning of the product, Woman Powerhouse may make a deduction from the refund corresponding to the resulting diminished value, to the extent permitted by applicable law. Woman Powerhouse will not make a deduction for damage or deterioration for which you are not responsible.

All responsibility and risk for the returned product remains with the customer until the product has been delivered to Woman Powerhouse. We recommend using a tracked delivery service and retaining proof of shipment until the return has been received and processed. Woman Powerhouse is not responsible for loss or damage occurring during the return shipment where such loss or damage is attributable to the carrier or to inadequate packaging by the customer.

7. SALE AND DISCOUNTED PRODUCTS

Discounted, sale and promotional products are not automatically excluded from the statutory right of withdrawal. Where the statutory right of withdrawal applies, it also applies to discounted products.

Any additional voluntary return conditions for promotional products will be communicated clearly before purchase and will not restrict statutory consumer rights.

8. DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS

If you believe that a product is defective, damaged upon delivery, incorrect, or otherwise does not conform to the contract, please contact Woman Powerhouse as soon as reasonably possible at the customer service email address provided on our website.

Please include your order number, a description of the issue and, where possible, clear photographs showing the defect or damage and the condition of the product and packaging. This helps us assess the issue and arrange an appropriate solution.

Where a product is defective, damaged, incorrect, or otherwise does not conform to the contract, your statutory rights remain unaffected. Depending on the circumstances and applicable law, you may be entitled to repair, replacement, a price reduction, or termination of the contract and a refund.

9. LEGAL GUARANTEE AND CONFORMITY

Products sold by Woman Powerhouse must conform to the agreement. This means that a product must have the characteristics and functionality that you may reasonably expect based on the agreement, the product description and applicable law.

Your rights depend on the product, its expected lifespan and the circumstances of the case.

Any commercial warranty offered by Woman Powerhouse or a manufacturer is additional to and does not replace your statutory consumer rights.

10. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The statutory right of withdrawal does not apply in certain situations specified by law. Depending on the products offered by Woman Powerhouse, this can include, for example:

·  Products made to the consumer's specifications or clearly personalised.

·  Sealed products that are not suitable for return for reasons of health protection or hygiene when the seal has been broken, where the statutory requirements for this exception are met.

·  Sealed audio or video recordings or computer software when the seal has been broken, where applicable.

·  Digital content not supplied on a tangible medium where delivery has begun with the consumer's prior express consent and acknowledgement that the right of withdrawal is thereby lost.

Any statutory exception will only be applied where all applicable legal requirements are met and the consumer has been informed of the exception before the purchase.

11. DIGITAL PRODUCTS

If Woman Powerhouse offers digital products, such as E-books, downloadable planners, journals, templates or other digital content, special rules may apply.

For digital content not supplied on a tangible medium, the statutory right of withdrawal may be lost once delivery begins, but only where the consumer has expressly consented to delivery beginning during the withdrawal period and has acknowledged that this results in loss of the right of withdrawal, as required by law.

If the required consent and acknowledgement have not been obtained, Woman Powerhouse will not rely on the loss of the statutory right of withdrawal.

12. INTERNATIONAL RETURNS

For purchases delivered outside the Netherlands, additional customs, import duties, taxes or other charges may apply. These costs are not refunded when you exercise your statutory right of withdrawal.

Mandatory consumer protection rules in the country of delivery may apply where required by law. Nothing in this policy limits such mandatory rights.

13. RETURN RISK AND PROOF OF POSTING

When you return a product, you are responsible for the product until it has been delivered back to Woman Powerhouse, unless applicable law provides otherwise. We recommend using a tracked shipping service and keeping your proof of postage and tracking information until your return has been processed.

If the returned parcel is lost or damaged during return transport, you may need to make a claim with the carrier. This does not affect your statutory rights.

16. CHANGES TO THIS RETURN POLICY

Woman Powerhouse may update this Return Policy from time to time, for example when our products, services, return process or applicable legal requirements change. The version published on our website applies to purchases made after its effective date.

No update will remove or restrict statutory consumer rights that apply to purchases already made.
